You can when it's existence can be deemed to be in violation of existing laws, and it's illegal to prevent it's removal, as also determined by the Supreme Court. If you can counter argue this, you should re-open this case and go in front of the Supreme Court.

. Why were they sent together to one place? because they were refugees. It would be in inhumane to split them up. That is how refugees have been worked with for hundreds of years in the US.
